Not only is it illegal to post someone's intellectual property, the owner of the site where it's posted can be in big trouble (in the states anyway). Bill Clinton did those of us who create intellectual property that gets violated a big favor. It's called the Digital Millennium Copyright Act. If the owner of the hosting site is notified (with a "DMCA letter"), and doesn't remove it shortly, or get proof of ownership from the poster, they can be seriously fined. I believe it's a half million US dollars for a first offense, a million for the second. I have gotten Ebay auctions deleted for copyright infringement, and one whole store on the YaHoo store platform closed for repeat offenses. Hosting companies don't care much for this kind of liability, in the USA at least. I don't know what Nigel's legal exposure would be for having links to stolen property on his site, but I'd certainly delete them. Besides, he is an intellectual property owner, he's likely to take the owner's side.
There ought to be classes in high school these days about intellectual property law. The fact that someone posted something does not make it legal, or ethical, to link to it or download it without paying for it. The creator needs to get compensated for their effort, or the whole system breaks down. The internet could easily cause the loss of creation of original works. |
In reply to Message (42598) Question About Deleted Posts
By Anonymous - Tue 05/01/10 16:15:59 GMT I notice that the original post containing some rapidshare links has been deleted, as well as several recent posts asking about the deleted post. Personally I'm disappointed because I never had a chance to download the videos because rapidshare has been too busy, but I'm curious why the posts keep getting deleted. I understand these videos were at one time copyrighted material, but do these videos not become public domain if the site no longer exists?
It would also be nice to know if there is any way to search for these links on rapidshare without knowing the exact file name or the download address. Please don't reply with a link or exact address though, as such posts seem to be getting deleted, but rather general tips for finding material on rapidshare.
