I've had to take action on stolen images so I have some experience in this area. Just because you found them free and unmarked on the net doesn't mean you can post them legally. Someone may have bought a set, and illegally posted them. Then if you happened by not knowing they were posted illegally and copied and posted them, you are still in possession of stolen property even if you didn't know. The owner can report it to your hosting provider, and if they are not immediately removed, it is, I believe, a $500,000 fine for the server owner under the Digital Millennium Copyright Act. I had a competitor's entire online store deleted by his hosting provider for multiple repeat offences of using my photos. As far as I know you will not get fined if you take them down immediately when notified, but your hosting provider may get tired of the risk and dump you if they get notified because it is served from their IP address. Now if the server is yours, they may fine you if you don't take them down, or maybe get your bandwidth provider to cut you off.
This is why YouTube is so quick to delete background music. They would get fined for hosting it even though they didn't post it. |

A great number have names or markings associated with them, some simply that we know to whom they belong and alot that are marked. Regarding the balance seen net wide might it be presumed these images are for public use? Not of course to be relabeled and presented as ones own creation but only to be categorized and archived. I ask you as a guru of wetlook and the copyrights granted to producers. I have many hundreds of freely obtained, unmarked images I'd like to archive on my site, do you see anything wrong with this?? |
