Okay, so there seems to be this 'law' in Germany/Austria and Italy seems to have something similar...
So why not host your websites with an company the USA or England or any of the other countries that don't have this issue? You are then not 'publishing' the pictures in your own country, the fact that people from your country can see them is irrelevant, all the Germany authorities could do, 'in theory', is try to block the site from the German audience!
There have been several ex-British spies that have got around the Official Secrets Act by publishing their memoirs overseas, the government here obviously tried to 'ban' the books, but it's not really possible...
... any country trying to unilaterally 'ban' something these days is really fighting a loosing battle.
If Robbi wants to register www.wasser-stoff-online.COM then I'll gladly host it for him on my US based server.

Apart of that there are many possible views. Generally, if you wish to publish pictures taken in the public and the pix show people clearly enough you need permission from them, as long as they are not people of public intrest (i.e. celebs, politicans, etc.). If the pix show people but they cannot be identified (i.e. backwards or faces blurry) there is no need for permision. If you take pictures of the place itself or you are photographing your friends and there are people around you can publish the pix. But if someone out of the background is shown identifiable and he complains you need to remove the pic.
Anyway, I like candid pix and I for myself think it should be possible to publish those pix as long as no one is shown doing intimite things. Of course if some subject complains and the pix are not of public interest they should be removed, wether the law is with the subject or with the publisher. But this is my personal oppinion and no law at all ;-) |

No it isn't! I don't think it is in your country either! As the photographer who took the pictures, you own them, it is your right to put them wherever you want! If the subject of the photos does not like it, they have the right to sue for their removal, however, that would simply result in you being ordered to remove them!
Shaky ground: Taking pictures with a hidden camera! If you take pictures with a concealed camera you risk breaking the law! Minors, must take care not to post candid pictures of minors!
Now I know that people are all going to leap on the candid bashing bandwagon, but these are the rules and the law!
How do you think the gossip mags are able to survive? Do you think they have permission to publish all the pictures they take??? Do you think Micheal Douglas gave permission for the UK newspapers to publish pictures of him just after plastic surgery, with his ears hanging off? How do the paperazzi exist?
I am annoyed that this will start yet another bloody dabate, thanks Robbi!

Nice to hear that on this forum. They have the right, that their pictures are NOT shown in the internet without their explicit permission. We can do pictures WITH the permission of the models - that's the right way Keep on in this way - hope many others will follow.
