You can apply the fun with a willing participant point to both push ins. She does not appear to be willing or having fun. Maybe her friend did it, maybe she 'took it in good spirits' after, but before that somebody twice her size and strength physically forced her to do something she didn't want to. None of these maybes are mitigating circumstances to throwing a girl in a fountain against her will.

No. I have a problem with that too.

However, we don't know what happened earlier in the story. It is at least possible that she was thrown in by people she knew, and she knew what was happening. It is at least possible that she would have taken it in good spirits, even if unlikely, and I'm pretty sure she would have been upset anyway. I very much doubt she got up in the morning anticipating being drenched in her clothes.

It is also likely that some of her possessions were ruined too.

However, with the photographer that was thrown in, I can't see any mitigating circumstances whatsoever.

I feel so sorry for that guy. Those two bullies that pushed him in behave like total thugs. The way they ran off afterwards... I can't see then coming forward and owning up. I hope he was able to use the video evidence to sure them for damages. There's a world of difference between fun with a willing participant and this. Which looks moot like assault.
